1. About these terms

These Terms of Use (“Terms”) are an agreement between you and Rubellite Ltd, a company registered in England and Wales (company number 13504030) with its registered office at 80 Mary Slessor Street, Coventry, CV3 3BX (“we”, “us” or “our”). They apply to your use of PatternPix, our iPhone and iPad app for creating patterns and designs, previewing them in augmented reality (AR), and exporting them (the “Service”).

In these Terms, “Designs” means the motifs, patterns, fills, effects, pattern packs and other content that we supply in the Service. “Your Creations” means the patterns and artwork you make using the Service.

By downloading, using or buying anything in the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

These Terms also serve as the licensed application end user licence agreement (EULA) for PatternPix.

3.1 What is free and what is paid

The Service includes free features, such as basic patterns and design tools, exports with a watermark.

Paid features are available through the following auto-renewable subscriptions:

We may also offer pattern packs and other content as one-time in-app purchases.

The title, features, length of each subscription period and price are shown on the subscription screen in the app before you buy.

We may add, change or remove plans, features and prices, but changes will not affect a period you have already paid for.

3.2 Billing through Apple

All subscriptions and purchases are processed by Apple using your Apple ID, and we do not receive your payment details. Payment is charged to your Apple ID when you confirm the purchase. Subscriptions renew automatically for the same period, at the then-current price, unless you cancel at least 24 hours before the end of the current period. Apple may charge for renewal within 24 hours before the current period ends.

3.3 Managing and cancelling

You can manage, change or cancel your subscription at any time in your Apple ID settings (Settings > your name > Subscriptions). Apple decides when a change of plan takes effect. Cancelling stops the next renewal, and you keep access to paid features until the end of the period you have paid for. Deleting the app does not cancel your subscription, and we cannot cancel Apple subscriptions for you.

3.4 Free trials

If we offer a free trial, you will be charged when it ends unless you cancel at least 24 hours before the trial ends. If you buy a subscription during a trial, any unused part of the trial is lost.

3.5 Refunds

Apple handles payments and refunds for App Store purchases. To ask for a refund, use reportaproblem.apple.com or contact Apple Support. Nothing in these Terms affects your legal rights as a consumer. Where the law allows, and with your agreement when you buy, you lose the 14-day right to cancel digital content once delivery has started, for example when you download a pattern pack.

3.6 One-time purchases

Pattern packs and other one-time purchases are licensed to you, not sold. You can restore them, and any active subscription, on your devices that use the same Apple ID by using “Restore Purchases” in the app.

4. Licence to use designs

Subject to these Terms, we grant you a non-exclusive, non-transferable, worldwide licence to use, reproduce and modify the Designs, as part of Your Creations, in the ways set out below.

Personal Licence Personal, non-commercial projects only, such as personal art, hobby crafts, gifts, home decoration, or content that is not sold or used to earn money. Exports from the free version carry a watermark and are for personal preview only.
Commercial Licence Use in commercial projects for you or your clients, such as printed fabric and wallpaper, stationery, packaging, merchandise, print-on-demand products, marketing materials, websites and apps, and other products or services offered for sale, in any number of end products. You may deliver finished work to clients, but not the Designs as standalone files for them to reuse. Selling an end product that shows a pattern (including a pattern printed on a product) is allowed, subject to Section 5.

Which licence you have depends on the plan or purchase you have made. The Personal plan includes the Personal Licence. The Commercial and Full Bundle plans include the Commercial Licence. The AR Preview plan does not include a licence to use exports commercially. If you are not sure which licence you have, treat your use as personal, or contact us before using a Design commercially.

Files you export while your plan is active keep the licence that applied at the time of export, even if you later cancel or downgrade. After cancelling, you cannot make new exports under the paid licence.

7. Ownership and intellectual property

The Service, the Designs, our software, branding and other content are owned by Rubellite Ltd or our licensors and are protected by copyright and other laws. These Terms give you a licence to use them as described in Section 4, and do not transfer ownership to you. PatternPix and our logos are our trade marks, and you may not use them without our written permission.

8. Your content

You keep ownership of your original content, including the original elements in Your Creations and any photos or images you add. You give us a limited, non-exclusive licence to store, sync and process that content only as needed to provide the Service to you. We do not publish your designs. You are responsible for making sure you have the right to use any image, photo or artwork you add to the Service.

9. Termination

You can stop using the Service at any time. We may suspend or end your access if you seriously or repeatedly breach these Terms, use the Service fraudulently or abusively, or where the law requires. If we end your access because of your breach, your licence under Section 4 ends and we are not required to refund you, except where the law says otherwise. Sections that are meant to continue after termination (including Sections 5, 7, 10, 11, 12 and 14) will continue.

10. Disclaimers and your legal rights

We work hard to keep the Service running well, but we cannot promise that it will always be available, error-free or suit every purpose. To the extent the law allows, the Service is provided “as is” and “as available”.

If you are a consumer, nothing in these Terms affects your legal rights, including your rights under the Consumer Rights Act 2015 (for example, that digital content should be of satisfactory quality, fit for purpose and as described). For advice about your rights, you can contact Citizens Advice.

11. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that, and to the extent the law allows: we are not liable for losses that were not reasonably foreseeable, or for loss of profit, revenue, business or goodwill; and our total liability to you for all claims arising from the Service will not exceed the amount you paid us (through Apple) in the 12 months before the claim. We are not responsible for losses caused by relying only on the AR preview when ordering, printing or buying products.

12. Business use and indemnity

If you use the Service under the Commercial Licence, or otherwise for business purposes, you agree to compensate us for reasonable losses and costs (including reasonable legal fees) that we suffer because you used the Designs outside the licence, breached these Terms, or used content you had no right to use. This section does not apply to you if you are using the Service only as a consumer.

13. Apple App Store terms

If you get the Service from the Apple App Store, the following also apply. They are between you and us, not Apple.

14. Governing law

These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring claims in the courts of the part of the UK where you live, and you keep the protection of any mandatory consumer laws where you live.

15. Changes to these terms

We may update these Terms from time to time, for example to reflect new features or changes in the law. If we make material changes, we will tell you (for example with an in-app notice or by email) before they take effect. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, you can stop using the Service and cancel your subscription.
